Definition<\/strong><\/p>\n

This compendium of the customs and usage of the profession of\u00a0 antiquarian bookseller defines the usages generally and universally\u00a0 recognized in all commercial transactions relating to the profession,\u00a0 either between professionals, or between professionals and institutions\u00a0 or individuals. Antiquarian bookselling in this context includes manuscripts, autograph letters, prints, maps and drawings, as\u00a0 well as books, and any other written or printed material.<\/p>\n

Code of Practice<\/strong><\/p>\n

Members of the Antiquarian Booksellers’ Association – Hungary (hereafter, for the sake of brevity, referred to as members) should conduct all commercial transactions according to these\u00a0 usages which expressly indicate that members offer to their clients\u00a0 a clearly defined code of practice based on high ethical standards.<\/p>\n

Description and Disclosure<\/strong><\/p>\n

Members shall be responsible for the accurate identification\u00a0 and description of all material offered for sale. All defects,\u00a0 significant restorations and sophistications or omissions should\u00a0 be clearly noted and made known to those to whom the material\u00a0 is offered or sold.<\/p>\n

Intention to return an item should be communicated\u00a0 as soon as possible within an agreed time frame and in accordance with local laws. When no prior agreement has been made, the communication\u00a0 of intent should be made no later than ten days after receipt\u00a0 of the goods.<\/p>\n

Refunds should be made or credited to the\u00a0 credit card promptly when a customer has made a return acceptable\u00a0 to the dealer.<\/p>\n

Technical Terms<\/strong><\/p>\n

Members should, as professionals, be conversant with and responsible\u00a0 for the correct use and interpretation of the technical terms\u00a0 of the trade.<\/p>\n

Price<\/strong><\/p>\n

Members\u00a0 shall be responsible for the professional pricing of all material\u00a0 offered for sale, regardless of whether they are dealing with\u00a0 experts or amateurs.<\/p>\n

Authenticity<\/strong><\/p>\n

Members shall vouch for and make every reasonable effort to substantiate\u00a0 the authenticity of all materials offered for sale. Should it be determined that such material is not authentic or is questionable,\u00a0 then it shall be returnable for a full cash refund, or on some\u00a0 other mutually agreed terms. Material shown to be not authentic,\u00a0 or of disputed or undetermined nature, shall not again be offered\u00a0 for sale unless all facts concerning it are clearly disclosed.<\/p>\n

Stolen Property<\/strong><\/p>\n

Members shall be responsible for passing to the buyer clear title\u00a0 to all material sold, and shall not knowingly purchase, hold\u00a0 or attempt to re-sell stolen material. Due diligence practices\u00a0 include knowing, or confirming, the identity of a vendor, recording\u00a0 all purchases and taking reasonable steps to ensure the legitimacy\u00a0 of goods being offered. In the event of books suspected of having\u00a0 been stolen, or having been proved to have been stolen, it is\u00a0 the responsibility of the members to contact the original owner.\u00a0 They shall co-operate fully with law enforcement authorities\u00a0 to recover and return stolen material, and to apprehend those\u00a0 responsible.<\/p>\n

Damage in Transit<\/strong><\/p>\n

Responsibility for damage or loss in transit shall rest with the sender. Members should attend to the careful and appropriate handling, packing, posting and shipping of material to ensure that it reaches the buyer in the same condition as when purchased.<\/p>\n

Terms and Conditions<\/strong><\/p>\n

It should be understood that books are normally\u00a0 offered for sale in catalogues, and on online databases and websites\u00a0 at the price affixed, subject to prior sale, and that payment\u00a0 is either due in advance or, when satisfactory credit has been\u00a0 established, promptly on receipt of the goods, or within 30 days\u00a0 of invoice if prior arrangement has been made. In the case of\u00a0 special offers, courtesy requires that an option to purchase\u00a0 be assured for a certain time which should be specified. Any\u00a0 divergence from these generally accepted terms should be expressly\u00a0 stated.<\/p>\n

Bank Charges<\/strong><\/p>\n

The supplier must be paid the full amount of his invoice; the\u00a0 buyer is responsible for all clearing and bank charges relating\u00a0 to the transaction.<\/p>\n

Tenders<\/strong><\/p>\n

When a bookseller makes an offer to purchase books the price should be valid either for an immediate transaction or for a\u00a0 stated period of option.<\/p>\n

Clear Pricing<\/strong><\/p>\n

Members should ensure that all material offered for sale in an\u00a0 open shop or at a book fair is clearly marked with the selling\u00a0 price. Material not for sale or being processed or reserved, should be appropriately segregated.<\/p>\n

Multiple Orders<\/strong><\/p>\n

If a multiple order cannot be filled in its entirety owing to part of it having been previously sold, this does not constitute\u00a0 grounds for the cancellation of that order unless so stipulated\u00a0 on the order.<\/p>\n

Valuations and Appraisals<\/strong><\/p>\n

Valuations must be carried out scrupulously in the\u00a0 spirit of these usages and customs. They involve the responsibility of the bookseller towards the owner of the material.<\/p>\n

Members offering valuation or appraisal services\u00a0 shall be responsible for being conversant with the relevant regulations\u00a0 as stipulated by local tax laws. They shall conduct such appraisals in strict compliance with these regulations.<\/p>\n

Auction Commissions<\/strong><\/p>\n

Members who receive from a client instructions to purchase at a public auction sale should also accept responsibility\u00a0 for the careful inspection of the material to be bought and should\u00a0 not rely solely on information supplied by the seller or by the\u00a0 auctioneer. He or she should, of course, also exercise the utmost\u00a0 discretion and eliminate any risk of conflict of interest.<\/p>\n

Unless otherwise agreed before the sale, a\u00a0 commission fee, on the hammer price, of 15% is normally charged\u00a0 on successful bids only. While bidding at auction is certainly open to variable commission rates, it is important for these to be discussed and agreed, in writing if necessary, before the\u00a0 auction.<\/p>\n

Preservation<\/strong><\/p>\n

Members are committed to the preservation of historical materials and should not break complete and intact copies of books or manuscripts.<\/p>\n

Investment Schemes<\/strong><\/p>\n

Members are advised not to promote antiquarian and\u00a0 rare books, or allied materials, as investment vehicles in themselves,\u00a0 or as part of investment schemes.<\/p>\n","protected":false},"excerpt":{"rendered":"
